Vehicle traffic accident reconstruction procedure

1. According to Article 3-1-1 of the Road Traffic Accident Reconstruction Regulations: The investigation committee only accepts traffic accident cases processed by the police authority, cases submitted by parties involved in a traffic accident, their heirs or legal agent or vehicle owners, as well as cases submitted by the agency which processed the scene of the traffic accident or judicial justice agencies. However, the following cases will not be accepted for investigation: 1. Cases that are still in litigation in the judicial justice system and have not been submitted by various agencies, therefore parties involved in the cases that are still in litigation should ask the judicial agency to apply to the bureau for a reconstruction.
2. Per Article 10 of the same regulation: When the parties involved object to the investigation committee's investigation outcome, they should apply to the Traffic Accident Investigation Reconstruction Committee for reconstruction by stating their justification within 30 days of receiving the investigation report and the process can only be conducted once. Those that are in judicial justice litigation should apply to the relevant judicial justice agency to forward the case to the Traffic Accident Investigation Reconstruction Committee for reconstruction. Those that are not in judicial litigation may apply within 30 days of receiving the investigation report.
3. Special traffic accidents that are unable to be investigated and reconstructed within the deadline may be extended once for a period of no more than 2 months.
